Terms of Service

Last updated: October 13, 2026

These terms govern your use of Ben, the website and app at twobens.com and the emails it sends (together, the "Service"). The Service is operated by James D. Scurlock ("we," "us"). By subscribing to or using the Service, you agree to these terms. If you do not agree, do not use the Service.

1. What Ben is

Ben applies fixed, published formulas (adapted from methods described by Benjamin Graham) to figures taken from companies' published financial statements, such as diluted earnings per share and cash flow, and to share prices entered weekly. It publishes the results as weekly lists, stock lookups, alerts and related content. The same formulas and the same information are provided to every subscriber.

2. Not investment advice

Ben is a publication of general, impersonal information. It is not investment, financial, legal, accounting or tax advice, and it is not a recommendation or offer to buy, sell or hold any security. Ben does not take into account your financial situation, objectives or needs, and no adviser-client, fiduciary or broker relationship is created by your use of the Service. Neither we nor Ben are registered as an investment adviser or broker-dealer. You are solely responsible for your own investment decisions. Before investing, consider consulting a licensed financial professional. Investing involves risk, including the loss of principal. Past results and calculated values do not predict future performance.

3. Accuracy of information

Ben's figures are calculated from data collected from public filings, company reports and other sources, some of it entered by hand, and they may contain errors, omissions or delays. Prices may be up to a week old and may come from different markets and currencies. Ben marks some figures that look unusual, but the absence of a mark does not mean a figure is correct. The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, completeness, timeliness, merchantability or fitness for a particular purpose.

4. Your subscription

5. Your account

You sign in with a link sent to your email address. Keep access to that email account secure; anyone who can open your sign-in emails can use your subscription. A subscription is for one person. You may not share your access, resell or redistribute Ben's content, or use automated tools to copy or scrape the Service.

6. Acceptable use

You agree not to misuse the Service, including by interfering with its operation, attempting to access it without authorization, or using it for any unlawful purpose. We may suspend or end access for anyone who breaches these terms; where a subscription is ended for breach, no refund is due.

7. Content and ownership

The Service, including its design, text, lists, calculations, compilation and software, is owned by us or our licensors and is protected by intellectual property laws. Underlying facts from public filings belong to no one; our selection, arrangement and presentation of them is ours. You may use the Service for your own personal, non-commercial purposes. Quotations from other authors are reproduced with attribution for commentary, and remain the property of their respective owners. Ben is not affiliated with, sponsored or endorsed by any person quoted or named in the Service, or by the publishers of their works.

8. Third-party services

The Service relies on third parties, including for hosting, email and payments. We are not responsible for their services, and your use of them may be subject to their own terms.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, investment losses, or loss of data, arising from or related to your use of, or inability to use, the Service or any information in it, even if we have been told such damages are possible. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim arose.

10. Indemnity

You agree to indemnify and hold us harmless from claims, losses and expenses (including reasonable legal fees) arising from your breach of these terms or your misuse of the Service.

11. Changes to the Service and these terms

We may change, suspend or discontinue features of the Service. If we discontinue the Service entirely, we will refund the unused portion of any prepaid subscription. We may update these terms; if a change is material, we will notify subscribers by email at least 30 days before it takes effect. Continuing to use the Service after a change takes effect means you accept it.

12. Governing law

These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Orange County, Florida, unless applicable law requires otherwise.
